29 CFR 1904.33(a): 29 CFR 1904.33(a): The employer did not maintain the OSHA 300 log, the privacy case list, the annual summary and the OSHA 301 Incident Report forms for five (5) years following the end of the calendar year that those records covered. (a) The employer could only provide a representative of the Secretary with a single year (2012) OSHA 300 log and Annual Summary. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
