29 CFR1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s). a) Facility: On or about August 26, 2024 and times prior to, the employer did not remove from service the Toyota 8FBE18U 36v powered industrial truck in use with bald front drive tires and an inoperable rear facing brake light. b) Facility: On or about August 26, 2024 and times prior to, the employer did not remove from service the TCM FG23T3L LPG powered industrial truck in use with inoperable rear facing brake lights and dry rotted/cracked rear tire treads with uneven wear.
