29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: On or about February 23, 2012, employees were using a spreader bar attachment on the forks of a JCB telescopic handler, Model #508, VIN #SLP5CBKA7U1290281, to lift the unsecured, light-guage, steel roof trusses being erected onto the new Sealy Police Department building, exposing employees to the hazard of being struck by materials and/or loads. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that modifications or additions which affect the capacity or safe operation of the equipment are not made without the manufacturer's written approval.
