29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) 38 Long Beach Blvd., Long Beach, NJ: The employees were utilizing scaffold at a height greater than 12 feet from the ground level without the use of fall protection. The employees did not use guardrails or a personal fall arrest systems to protect themselves, observed on or about 4/20/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
