29 CFR 1910.178(l)(4))(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely: (a) Warehouse - The employer did not provide refresher training and an evaluation on the training's effectiveness to each powered industrial truck operator involved in an accident or near-miss incident, including to an operator who drove a clamp truck into a pole, resulting in a chest injury requiring 32 days away from work, on or about November 10, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
