Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of being struck or crushed by the hoisted load and the crane body/boom of the 80 ton Link Belt Lattice Boom Crawler Crane Model Number LS - 138 II Serial Number H7J1-5924. The crane operator responded to the signals of the Drilling Company Tool Pusher, a person neither trained nor appointed to act as the signal man for the operation. a) Among other methods, one method of abatement is to ensure that the crane operator shall respond to signals only from the appointed signal man, in accordance with section 5-3.1.3(c) of the American National Standards Institute (ANSI) B30.5-1968, Crawler, Locomotive and Truck Cranes.
