29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition: On or about February 16, 2018, the employer was not enforcing the use of seat belts when employees were operating the AUSA D 600AP articulating chassis dumper truck. Employees were operating the truck with loads of soil in it over rough terrain without wearing a seat belt. Employees exposed to the hazard of being crushed by the truck in the event of a roll over.
