Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of an elevator failing during operation due to the lack of an inspection by an enforcing authority: a)Job Site: Employees were exposed to potential hazards from an elevator that was not inspected in accordance with the Handbook on A17.1 Safety Code for Elevators and Escalators, ASME A17.1-1993, Rule 1000.2. Constantine D&B Ltd employees used the elevator daily to transport tools, equipment and personnel to the upper floors. The elevator was not inspected by an enforcing authority prior to use, on or about 7/12/05. Among other methods, one feasible and accepted means of abatement to correct this hazard is to follow guidelines outlined in the Handbook on A17.1 Safety Code for Elevators and Escalators, ASME A17.1-1993, Rule 1000.2, " Applicability of Inspection and Test Requirements", that requires an acceptance inspection and test to be performed before the equipment is turned over for service. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
