29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely. On or about February 10, 2022, the employer failed to ensure that powered industrial vehicle operators receive refresher training immediately following an accident. Employees working in the production area were exposed to struck-by hazards associated with the Crown #3 6000-pound PIV. An operator of the Crown #3 PIV immediately returned to work and continued to operate the PIV without refresher training.
