OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards due to flammable volatile material heated in an industrial oven that was not designed for use with flammables : a) VPI Area - On or about August 28, 2013, an industrial walk in oven (Oven #1, JPW Design & Manufacturing Model # ST216TULEP460V90KWCH Serial #00847 Classification NFPA 86 Class B) used for a process involving a flammable liquid, including but not limited to Elantas RanVar B7-373 VTC containing Vinyl Toluene (FP 108 degrees F), was not adequately designed to protect employees from fire and explosion hazards with use of flammable chemicals. b) VPI Area - On or about August 28, 2013, an industrial walk in oven (Oven #2, JPW Design & Manufacturing Model # ST216TULEP460V90KWCH Serial #00849 Classification NFPA 86 Class B) used for a process involving a flammable liquid, including but not limited to Elantas RanVar B7-373 VTC containing Vinyl Toluene (FP 108 degrees F), was not adequately designed to protect employees from fire and explosion hazards with use of flammable chemicals.
