OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: At this location, employees were not protected against being struck by and crushed by wheel loaders during loading operations when refueling activities were performed in areas where loading operations were occurring. No effective means of traffic control was in place to prevent employees from being in areas of restricted vision of wheel loader operators when refueling.
