Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to tipping and crushing hazards while operating a TCM forklift without a seat belt. (a)Good's Store, Store Wide - On or about March 1, 2012 a TCM forklift used to move pallets of materials was operated by employees and no seat belt had been installed by the employer. Feasible and acceptable methods of abatement to correct this hazard include ITSDF B56.1-2009, Paragraph 7.4.1 which requires a restraint system be installed on forklifts to reduce the risk of entrapment of an operators head and torso between the truck and ground in the event of a tip over. Abatement certification required within 10 days after the abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.tives
