North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a) within the facility, the Raymond forktruck was being used to support and lift a 3 ft x 4 ft manlift that was not secured to the lifting carriage or forks.
