Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential fire and explosion hazards: (a) In the pellet storage bin located at American Crystal Sugar in Drayton, North Dakota, an employee was using a diesel powered Caterpillar 906 compact wheel loader to move pellets to a conveyor. The Caterpillar was not approved for use in a Class II, Division 1, hazardous location where large volumes of combustible dust were present. Among other methods, one feasible and acceptable means of abatement would be for the employer to follow the guidelines established in NFPA 505 Fire Safety Standard for Powered Industrial Trucks Including Type Designations, Areas of Use, Conversions, Maintenance, and Operations, Section 4.2.6.
