Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to : (a) Bickel's Surplus (Pinecroft Store), RR #7, Box 921, Altoona, PA 16601: On or about April 25, 2008, an employee sustained fatal injuries as a result of falling approximately twenty feet from the forks of the Toyota forklift. The deceased employee was going to change an outdoor light. The employee was standing in a plastic tote, while other employees were sitting on the fork lift acting as counterweights. Among other feasible and acceptable means of abatement to ensure compliance at all future work sites, is to use a lifting platform, designed and approved for such use and is secured to the forks of an industrial truck as set forth in the Industrial Truck Standards Development Foundation (ITSDF) 56.1-2005 standard.
