Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: On or about 02/14/06, at the Country Cove Estate Development project, employees were installing chains on storm drain grates and plastering cement on the inside walls of the drains and not wearing high visibility vests when working in close proximity to vehicular traffic. Among other methods, one feasible and acceptable method to correct this hazard is ensure that employees put on high visibility vests before any work is conducted near vehicular traffic.
