North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being struck by the bucket of a skid steer loader: a)North Ridge Country Club maintenance area-on or about 09:50 AM on 12/15/04, an employee was tasked to position an 8'x4' section of plywood to prevent dirt from falling into a newly constructed concrete wash rack and was allowed to be under a load of fill dirt lifted approximately 7 feet over a chain link fence and was struck by the bucket of a John Deere model 250 skid steer loader which tipped over.(re: page 10 Operating Safety, of the operators manual for the John Deere Skid Steer loader models 240 and 250). One feasible means of abatement is to assure employees are restricted from working in close proximity to the bucket of a skid steer loader.
