Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a)On or about December 2, 2004, an employee was exposed to a crushing hazard when he stood on the rake attachment of a rubber-tired loader as the rake was lifted and the loader was moved forward to place the rake over a construction debris bin. Among other methods, one feasible and acceptable method to correct this hazard is only allow the operator on the machine, and to prohibit anyone from riding on the rake. ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
