Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of the instability of a rough terrain forklift: a) for employees operating the Lull 844C lift involved in the accident on or about October 12th, 2000 at 13548 Turtle Marsh Loop in Orlando, FL. An inspection was not performed by the operators to identify problems such as the by-passed limit switches for the boom. One means of feasible abatement, among others, would be complying with American National Standards Institute (ANSI) Standard B56.6-1993, Safety Standard for Rough Terrain Forklift Trucks, Section 6.5.1., requiring a rough terrain forklift truck to be checked at the beginning of each shift and before operating with special attention to: (a) tires and inflation pressure; (b) warning devices; (c) lights; (d) lift and tilt systems including load-engaging means, chains, cables and limit switches; (e) brakes; (f) steering mechanism; and, (g) fuel system(s). OR in the alternative, 29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: a) for employees operating the Lull 844C powered industrial truck involved in the accident on or about October 12th, 2000 at 13548 Turtle Marsh Loop in Orlando, FL. The employer did not perform, or require operators to perform, an inspection the Lull 844C powered industrial truck. An inspection with special attention to: tires, horn, lights, battery, controller, lift system (including load-engaging means, chains, cables and limit switches), brakes, and steering mechanism (as identified in paragraph 606.A. of ANSI B56.1-1969) would have identified problems such as the by-passed limit switches for the boom.
