Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Pier 40: Employees were driving heavy industrial equipment that have seat belts and the employees were not wearing the seat belts when operating the equipment. Among other methods one feasible and acceptable abatement method to correct this hazard is to wear the provided seat belts as referenced in ASME B56.1 - 2000 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS AND OSHA'S FORKLIFT TRAINING STANDARD."
