Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Fuel/Gas Station, Area 20, north end: On February 5, 2007, backhoe equipment was operated without the cotter pin to hold and secure the working bucket. Slippage of the coupling due to the missing pin could result in unintended separation of the bucket during operation or maintenance, potentially striking or injuring employees.
