Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to possible shock hazards, or electrocution in that 480 volt wires were not installed according to the National Electric Code: (a)Among other methods, one feasible and acceptable abatement method to correct this hazard is to install the electric wires per National Electric Code, sections 349-3, and 349-4, which state that flexible metallic tubing shall not be run in damp locations, exposed to physical damage, or buried.
