Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls of eight feet from an elevated pallet: a)American Bakery, Sanitizing Area: A custodian was at risk of falling up to eight feet from a pallet to either the concrete ground below or into a sanitizing tank holding a solution of Diversey Elect containing Sodium Metasilicate and hot water as he was lifted while standing on the pallet by an employee operating a Datsun Forklift. Note: Among other feasible and acceptable abatement methods would be to: 1.Construct the elevating platform in accordance with ANSI B56.1-1988, Section 7.34.1.1 which requires a slip resistant surface and Section 7.34.1.3, or equivalent which requires restraining means positioned at a vertical height not less than 36 inches nor more than 42 inches. 2.Provide a scaffold or solid construction. 3.Provide a ladder.
