Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls and being struck or crushed by the wheels or pinch point of the pivot area of end loader. a) Employees were observed riding in the bucket and on top of the steps on the side of the Komatsu front end loader, Model WA 350, in the vicinity of 4511 Causeway Boulevard, Tampa, Florida. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish and enforce a rule prohibiting such riding.
