Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a ladder while working on a neon sign: a) On, or about, December 30, 1989, at approximately 11:15 a.m., two employees were working on a neon sign while on a ladder 75 feet above the ground. The employees were not using safety harnesses or lanyards and were not tied off. One employee fell to his death. One of more acceptable abatement methods to correct this hazard would be to: 1) Establish written procedures for working on truck extension ladders and the use of body harness and lanyards. 2) Provide adequate number of body harnesses and lanyards. 3) Provide training in the use of body harnesses and lanyards. 4) Assure employees use body harnesses, lanyards, and tie off while working from ladders attached to articulating-boom and extensible- booms. 5) Employees working at the elevated heights from articulating-boom and extensible-boom be provided a work platform or bucket attached to the boom to work from with appropriate safety devices.
