Abstract: On August 12th, 2009, Employee #3 of Szemenyei Construction, Inc., was operating a Bobcat excavator, G-series model 341G, product ID number 234713865. He was digging a foundation of a block wall for a planter. There were bundles of metal lattice trusses stacked in the area, which were in the way of the excavator. Each of these metal trusses measured 36 ft. long and 18 in. wide. There were 6 trusses in each of the two bundles stacked one on top of the other. Employee #3 decided to move the trusses out of the way of the excavator. There was a retaining block wall about 7 ft. high parallel to the stack of trusses. Employee #3 asked Employee #1 and Employee #2 to help him move the trusses out of the way. They decided to place the two bundles of trusses on top of the 7 ft. high retaining wall and the dirt behind the wall, lifting one bundle at a time with the excavator. They hooked a bundle to the bucket of the excavator with a chain. As Employee #3 lifted the bundle with excavator, Employee #1 and Employee #2 got on top of the block wall to stabilize and guide the bundle to be set down on top of the wall. Employee #1 was holding one end and Employee #2 was holding the other end of the bundle suspended from the bucket of the excavator, when the bundle got unhooked and fell to the ground. Employee #1 also fell to the ground and got hit by the falling trusses. Employee #1 suffered fracture and dislocation injuries to both his shoulders and a laceration to his left leg. He was treated and hospitalized for 5 days.
