Abstract: At approximately 10:45 a.m. on July 9, 2009, Employee #1, a general warehouse man, was retrieving a vinyl roll (54 inches long by 12 inches in diameter) from the top shelf of a storage rack inside the warehouse. The top shelf was measured to be 13 feet above the floor. The employer is engaged in a general warehousing and vinyl distribution business. To retrieve the roll, Employee #1 was standing on an unguarded pallet that was being raised by the forks of a forklift. The forklift was being operated by another employee. At approximately eight feet above the floor, Employee #1 fell from the elevated pallet. He sustained a fractured right knee, and was hospitalized for about three weeks. Investigations revealed that he was not provided with, nor was he using, fall protection while he was at the elevated position.
