Abstract: At approximately 7:00 a.m. on April 7, 2007, Employee #1, a painter who had been employed for eight days, was painting the front exterior wall of a church from the roof of its porch that was 12 feet high. Employee #1 and a coworker were the only employees on site at the time. In order to access the roof, Employee #1 placed a portable fibrous glass extension ladder against the front of the church, adjacent to the roof. The ladder was not tied, blocked or otherwise secured to prevent it from moving. After bringing the painting materials and equipment that were needed onto the roof, the coworker climbed the ladder and got onto the roof. Employee #1 then began to climb the ladder. He reached the second or third step from the top of the ladder, when the feet of the ladder slipped out at the bottom, causing him to fall to the concrete slab below. He was hospitalized for injuries to his back.
