Abstract: Employee #1 was working as a clean-up boy. He was given an assignment by the manager and was told that because of his age, 17, he was not allowed to operate any power equipment. The manager walked him outside to the parking lot, where he told him to stack pallets. He began stacking the pallets and the manager left for the day. Employee #1 went back into the building after the manager left and climbed onto a forklift. He started the forklift and drove it outside. By this time it was dark outside and Employee #1 was not seen by other employees, nor was the motor of the forklift heard. Employee #1 was driving the forklift around the parking lot and turned too sharply causing the forklift to tip over. He tried to jump clear of the falling forklift but was unable to get completely out of the way. The forklift cage caught his right leg and the fork fell on and fractured his ankle. Employee #1 was hospitalized for his injury.
