Abstract: Employee #1 was observing the operation of the tracked excavator (Caterpillar 330 Serial Number X9PJ0178L) for clearance of the counterweight from obstructions at the excavation site. As the rear of the excavator was swinging near a light pole located at the corner of the site, Employee #1 moved to get a better angle of view of the relative position of the pole and counterweight. Employee #1 stepped up onto a pile of metal shoring materials including I-beams that were stacked between the light pole and the tracks of the excavator. He stepped down from the metal plate shoring and the stacked I- beams. Employee #1 was not in the line of sight of the operator of the excavator at that time. The tracks of the excavator slipped rearward about 3-in.-to-6-in. and Employee #1's right knee became pinned between the stacked I-beams and the tracks, crushing his right knee. Employee #1 was hospitalized.
