Abstract: At approximately 2:00 p.m. on November 18, 2004, Employee #1 was framing while remodeling a home. Employee #1 and a coworker were performing independent tasks on the opposite sides of a framed opening for a window. Employee #1 was working on the ground level of the home on the exterior side. The coworker was working from the interior of the structure. The interior working surface is higher than the exterior working surface. The wall consisted of just bare studs (i.e., no drywall or plasterboard). Employee #1 bent down in an area next to the wall to either nail or measure a piece of plywood. Employee #1 crouched down, stood up, and as he stood up he was struck by a nail fired from the pneumatic nail gun the coworker was carrying. According to Employee #1, the coworker was descending a ladder. The coworker contended that no ladder was present, and that he was standing on the interior of the structure when Employee #1 stood up from the ground on the exterior of the building, Employee #1's head struck the nail gun. Employee #1 suffered an inter-cranial injury and was hospitalized for five days.
