Abstract: At approximately 3:30 p.m. on July 19, 2004, Employee #1 was operating an SD-40 soil compactor. Employee #1's employer was to excavate a new home site based on soil engineer's recommendations. Due to space limitations, half of the excavation was dug out and the spoil placed on the unexcavated area at grade level. Once excavated, the employer was to backfill the area and recompact the soil. The soil was approximately 18 in. above the natural grade and had a 40-degree slope at the edge. Employee #1 was operating the compactor and the foreman and another employee were working at the opposite end of the site. One was watering the soil while the other was operating the backhoe performing excavation work. The employer had observed Employee #1 getting to close to the sloped edge of the backfill and had cautioned him to be careful. Employee #1 was inexperienced and worked part time. Employee #1 received only 1.5 hours training. Approximately 20 minutes went by when they noticed that the compactor was on its side. The employees found Employee #1, the compactor equipment operator, on the ground with the canopy of the ROPS on his head. The employee died instantly of massive head injury.
