Abstract: At approximately 1:14 p.m. on November 10, 2003, Employee #1 and three coworkers were in an excavation working to make a keyway for the footing of a retaining wall. The depth of the L- shaped trench varied but it was measured to be 8 ft, 3 in. deep near where Employees #1 was working. The L-shaped trench was approximately 38 ft long running east and west and approximately 125 ft north and south. The width was approximately 8-ft to 10-ft wide. The walls of the excavation had vertical cuts with no shoring or sloping. To make the keyway, Employee #1 was using a 90-pound electric hammer inside the trench, when a wall collapsed striking him. Employee #1 suffered lacerations on his head, a dislocated left shoulder, neck and back pain, and is having trouble hearing in his left ear. Employee #1 was hospitalized for one week.
