Abstract: On May 21, 2003, Employee #1, working as a painter, was assigned to assist in painting a home undergoing renovation. The employer identified the moulding that was to be disposed. Employee #1 disposed of moulding by sawing them into smaller pieces. He was using a portable electric hand saw (Skilsaw) he owned for the task with the permission of the employer. Employee #1 had not used the Skilsaw prior to this operation. He was working in the backyard of the property while his supervisor was painting inside the residence. Employee #1 attempted to saw the wooden moulding with nails still embedded in the wood. He was not using any other piece of equipment but his legs for support to hold the material. During the sawing operation, Employee #1 hit a nail in the moulding and the saw slipped out of the kerf. He sustained open first proximal metacarpal fracture with multiple extensor tendon lacerations to his left hand. Employee #1 was transported to Holy Cross Medical Center where he was admitted, had surgery and was released on May 23, 2003.
