Abstract: On July 3, 1999, Employee #1 broke his wrist when he fell from the roof while stacking trusses at a new housing project in Santa Clarita, California. The single family home was under construction by a contractor called CBC Framing. Employee #1 did not work for CBC Framing. He came out to the jobsite at the request of an employee of CBC Framing. He was not a supervisor, foreman, or a person with the authority to hire for the company. On the day of the incident, only a "skeleton" crew was working on the project. Employee #1 had begun stacking trusses. He fell from the top of the structure and injured his right wrist. He was taken to Henry Mayo Hospital for emergency treatment. CBC Framing provided the division with payroll and time sheet records for that week, and the records indicated that Employee #1 was not on the payroll. In fact, Employee #1 did not have any record of employment with the company. Furthermore, he had not filled out any job application forms, tax forms, or any other required documents for employment with CBC Framing. It appears there was no employer/employee relationship.
