Abstract: An employee and a coworker were framing and constructing an exterior stairway to a building. They had built a job made wooden supported scaffold so that they could access the upper landing. The scaffold was made of two wooden scaffold planks that were placed over the second floor balcony. The planks were placed on top of a horizontal wooden two-inch by four-inch post that spanned from the exterior wall to an upright stairway post. The planking was used as the work platform for the employee and was approximately 10 feet 3 inches above a concrete sidewalk. Between 3:00 p.m. and 4:00 p.m., the employee was walking on the planks when one of them slipped off of the end of the horizontal support. He fell and struck his head on the sidewalk. He was not taken for emergency treatment, nor was the local emergency medical services called. He was taken home by his father, the company owner, and given aspirin. At approximately 8:30 p.m. the employee was taken to the hospital where he later died from head injuries.
