Abstract: At approximately 2:15 p.m. on December 14, 1995, Employee #1 and a coworker were working in a forklift manufacturing plant in Oxnard, CA. They were attempting to lift a large counterweight using a chain and a Wiggins forklift, #WD 250 Y. The coworker was operating the forklift when Employee #1's right index finger became caught between the forks and the chain and was amputated. The coworker was helping Employee #1 and had not been trained in the safe operation of this forklift. The employer was cited for a violation of T8CCR 3664(a)(1). Employee #1 and the coworker were secondary employees under the direct supervision of the secondary employer.
