AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

THE CONSULADO GENERAL DE MEXICO EN DENVER, COLORADO

The Occupational Safety and Health Administration (OSHA), Denver Area Office and Englewood Area Office, the Wage and Hour Division (WHD), Denver District Office, The Equal Employment Opportunity Commission (EEOC) Denver District Office and the Consulado General de Mexico en Denver, Colorado, recognize the value of establishing a collaborative relationship to foster safer and more healthful workplaces for all Mexican citizens working in Colorado. OSHA, WHD, EEOC and the Consulado General de Mexico en Denver, Colorado hereby form an Alliance to provide hard to reach workers with information and guidance to help foster a culture of injury and illness prevention and ensure employee rights.

OSHA and the Consulado General de Mexico en Denver, Colorado will work together to achieve the following training and education goals:
  • Provide the Consulado General de Mexico en Denver, Colorado members with information and guidance to help them protect employees health and safety, particularly in reducing and preventing exposure to hazards associated with the Construction industry, the Migrant Farm Worker industry and Meat and Poultry Processing Plants.
     
  • Increase access to safety and health information and training resources to improve worker knowledge of safe work practices and the resources available to them.
     
  • Distribute information regarding the employees right to a safe and healthful work environment.
OSHA and the Consulado General de Mexico en Denver, Colorado will work together to achieve the following outreach and communication goals:
  • Jointly disseminate information through print and electronic media, including electronic tools and links to OSHAs website from the Consulado General de Mexico en Denver, Colorados Web site.
     
  • Appear at conferences, local meetings, or other events such as the Mobile Consulate meetings sponsored by the Consulado General de Mexico en Denver, Colorado, the Safety Fest of the West conference sponsored by OSHA, and other mutually agreed upon events.
     
  • Distribute information regarding the employees right to a safe and healthful work environment.
     
  • The Consulado General de Mexico en Denver, Colorado will act as a liaison between Mexican Citizens, who are working in Colorado, and OSHA to report unsafe working conditions and request an inspection.
WHD and the Consulado General de Mexico en Denver, Colorado, will work together to achieve the following outreach and communication goals:
  • Jointly build and maintain a long term relationship of cooperation to assure workers rights are protected to the fullest extent possible under the statutes enforced by WHD.
     
  • WHD provides ongoing training to the Consulado General de Mexico en Denver, Colorado staff to assure that they have a working knowledge of statutes enforced by the WHD.
     
  • Jointly participate in media events, conferences, local meetings, such as the mobile consulate to educate the constituents of the Consulado General de Mexico en Denver, Colorado regarding their rights under the labor statutes enforced by WHD.
     
  • The Consulado General de Mexico in Denver acts as a liaison between Mexican Citizens, who work in Colorado to report allegations of wage and hour violations.
The EEOC, Denver District Office, will commit to working with the Consulado General de Mexico en Denver, Colorado the following ways:
  • To build and maintain a long term relationship of cooperation to assure workers rights are protected to the fullest extend possible under the statutes enforced by the EEOC.
     
  • To provide ongoing training to the Consulado General de Mexico en Denver, Colorado staff to assure that they have a working knowledge of statutes enforced by the EEOC.
     
  • To participate in joint communications through the use of media to educate the constituents of the Consulado General de Mexico en Denver, Colorado regarding their rights under the statutes enforced by the EEOC.
OSHA, WHD, EEOC and the Consulado General de Mexico en Denver, Colorado will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:
  • Raise awareness of and demonstrate commitment to workplace safety and health and workers rights whenever OSHA, WHD, EEOC or the Consulado General de Mexico en Denver, Colorado leaders address groups.
OSHAs Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that partys products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular partys products or services.

An implementation team made up of representatives of all signatory organizations will meet to develop a plan of action, determine working procedures and identify the roles and responsibilities of the participants. In addition, they will meet at least quarterly to track and share information on activities and results in achieving the goals of the Alliance. Team members will include representatives of the OSHA Denver Area Office, the OSHA Englewood Area Office, the WHD Denver District Office, Equal Employment Opportunity Commission, Denver District Office and the Consulado General de Mexico en Denver, Colorado.

This agreement will remain in effect for one year from the date of signing and will automatically be renewed annually thereafter. This agreement may be modified at any time with the concurrence of all signatories and may be terminated for any reason with 30 days written notice from all signatories.
