August 27, 2007 Mr. James D. Hardin, II P.O. Box 945, AJ-1593 Marienville, Pennsylvania 16239 RE: "Scaffolds" Dear Mr. Hardin: This in response to your letter dated April 11, 2006 to the Occupational Safety and Health Administration (OSHA), which raised several questions regarding scaffolds. We apologize for the long delay in responding. We have paraphrased your questions below: Question (1): Does OSHA approve scaffolds used in construction? Does a manufacturer need permission from OSHA to manufacture and sell scaffolding? Answer: No. OSHA is generally precluded from approving or endorsing specific products. Also, there is no OSHA requirement that manufacturers receive permission from OSHA to make and sell scaffolding. Question (2): Are there OSHA construction standards that are applicable to scaffolds used in construction? Answer: Yes. These standards can be found at 29 CFR Subpart L, Scaffolds. You can view these standards on our website at http://www.osha.gov. Question (3): Does OSHA have a list of approved scaffolding manufacturers in the United States and abroad? Answer: No. OSHA does not maintain such a list. If you need additional information, please contact us by fax at: U.S. Department of Labor, OSHA, Directorate of Construction, Office of Construction Standards and Guidance, fax # 202-693-1689. You can also contact us by mail at the above office, Room N3468, 200 Constitution Avenue, N.W., Washington, D.C. 20210, although there will be a delay in our receiving correspondence by mail. Sincerely, Steven F. Witt, Director Directorate of Construction |
