J. Nigle Ellis, PH. D. Dear Dr. Ellis: This is in response to your inquiry requesting and interpretation of 29 CFR 1926.951(b)(4)(ii). Controlled descent devices, such as the Research Emergency Escape, listed by the Underwriters Laboratories, which automatically control the descent process of employees are acceptable for emergency rescue such as lowering a person to the ground. The subject devices are not required to meet the requirements for safety lines as specified in 29 CFR 1926.951(b)(4)(ii). However, the controlled descent devices must comply with the manufacturers recommendations. If I may be of further assistance, please feel free to call or write.
