Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about April 26, 2006, and at other times prior thereto at this location, the employer did not ensure the operator disengaged the Ditch Witch when employees entered the danger zone. Among other methods, recognized and feasible abatement to prevent exposure to the hazard includes, but is not limited to, ensure all supervisors and operators are formally trained on the safety requirements of the Ditch Witch as referenced in the RT40 Operator's Manual.r's
