Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls, drowning and/or asphyxiation: a.Site: Workers were exposed to the hazards of falls, drowning and asphyxiation when they were allowed to enter confined spaces without benefit of air monitoring, fall protection and/or protection from drowning. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement is to follow ANSI/ASSE Z117.1-2009, entitled Safety Requirements for Confined Spaces.
