Region VI Completed Partnerships with the Associated General Contractors of America, Inc. (AGC)
|
In Region VI, the Occupational Safety and Health Administration (OSHA) has had a long and beneficial relationship with the Associated General Contractors of America (AGC) and its local chapters regionwide. Since 1998, OSHA has formed forty-nine distinct Partnerships with AGC, and twenty-three were in Region VI.
Among the twenty-three Partnerships, three distinct models of Partnerships were developed to allow OSHA and AGC to provide assistance tailored to the various needs of the general contractors. Below, each model is described accompanied with a list of Partnerships utilizing the model.
Safety and Health Agreement Regarding Enforcement:
The first model, Safety and Health Agreement Regarding Enforcement (SHARE), focuses on assisting general contractors who need assistance with developing and implementing effective Safety and Health Management Systems (SHMS).
In this Partnership model, by participating, the employer agrees to implement an effective safety and health management system by focusing on the elements outlined in the 1989 OSHA Guidelines (Safety and Health Management System, Issuance of Voluntary Guidelines, 1989, January 26). The employer also agrees to provide data on a regular basis to allow for performance tracking including OSHA 300A logs, safety and health management system documents, and a monthly summary of all safety/health assessments for all work sites.
Benefits for participating in the program includes, so long as the employer is meeting the intent of the Partnership, OSHA on-site enforcement verification visits will be limited in scope to a review and evaluation of the safety and health management system(s), analysis of injuries, interviews of select employees to verify quality, and then a focused inspection to verify compliance. Also, participating employers will be eligible for penalty reductions. Finally, OSHA will endeavor to support the employer with reasonable requested training and also will furnish technical advice, publications and training material to the employer upon request

Partnership Results:
The efforts of this Partnership affected a total 21 employers in and around Baton Rouge and Shreveport, Louisiana over a period of six years. Numerous training opportunities were provided, covering a variety of topics including construction-specific Occupational Safety and Health Administration (OSHA) 10-hour training, recordkeeping, safety and health management system development, electrical standards, hazard recognition, and forklift safety. Partners also received technical assistance with regard to fall protection and recordkeeping.
Compliance Assistance Specialists (CAS) from the Baton Rouge Area Office also provided assistance and technical information upon request on work site related questions such as the proper usage of rebar-caps, roofing fall-protections requirements, and industrial truck training requirements.
At the conclusion of the Partnership, the Days Away, Job Restricted or Transferred (DART) rate of 1.4 represented a continued rate decrease since 2003. Also, the rate was 57% below the published 2006 Bureau of Labor Statistics rate for NAICS 23 (Construction) of 3.2. |

Partnership Results:
Over the duration of the Partnership, the participating contractors focused on implementing and improving their safety and health management programs. The contractors have learned to perform regular safety inspections of their sites and a majority of the identified hazards were corrected immediately with the remainder corrected within a few days. Also, employees have started to take ownerships of their safety and health management programs. Over the four years of the Partnership’s existence, the aggregate injury and illness rates of all participating members had downward trends.
Training was also provided and the employees of the participating contractors received the OSHA 10-hour construction-training course and received completion cards from the Occupational Safety and Health Administration (OSHA) Training Institute. Employees have taken ownership of the safety program. |

Partnership Results:
At the conclusion of the Partnership which impacted over 130,000 employees, the aggregate Total Case Incidence Rate (TCIR) and the Days Away, Job Restricted or Transferred (DART) rate were 53% and 55% below their established baseline rates with both below the national averages for the construction industry as determined by the Bureau of Labor Statistics.
By the end of the term, this Partnership covered 133,337 employees. Partners carried out 1,712 self-inspections and abated a total of 3799 hazards. With the assistance of the Occupational Safety and Health Administration (OSHA), this Partnership provided training to help the participating employers implement effective safety and health programs and improve upon them. Training topics included the OSHA 30 hour course among other construction safety related topics.
OSHA also attended monthly safety committee meetings with AGC members to answer questions, and also held exhibits at various conferences and trade shows. |

| Safety and Health AGC Partnership of Excellence
The second model, Safety and Health AGC Partnership of Excellence (SHAPE), is for general contractors with effective safety and health management systems in place. This program is intended to push these contractors to safety excellence beyond the minimum as defined by the 1989 Occupational Safety and Health Administration (OSHA) Guidelines.
The goals for this Partnership approach are:
- Reduce by 1.5% annually the number of injuries, illnesses, and fatalities affecting participant employers, with an emphasis on reducing injuries and fatalities resulting from falls, struck-by, caught-in/between mishaps, and electrocution (focused four construction hazards).
- Increase the number of construction companies that implement effective safety programs
- Decrease worker compensation costs and OSHA penalties for member companies
With this type of model, both AGC and OSHA recognize the importance of providing a safe and healthful work environment for the construction workforce. To advance the mutual goal, there is the need to develop a working relationship that fosters mutual trust and respect for each organization's respective role in the construction safety process. Accordingly, this Partnership contains the following strategies and objectives:
- Implementation of a continuing and open communication policy between the AGC membership and the OSHA Area Offices
- Sharing of knowledge of the best industry technology, innovations and work practices that improve jobsite safety and health performance
- Cooperation in the development and improvement of safety training programs for the construction industry and OSHA personnel
- Promotion and recognition for construction safety excellence
In order to participate, eligible employers must meet the following criteria:
- Injury / illness rates 15% below the industry averages
- Experience Modification Rate (EMR) of .75 or below
- Have had no willful violations in the previous three years
- Employ a safety and health representative with at least one year of experience
in managing an effective construction safety and health management system and
has received appropriate training in identifying and correcting construction
hazards
With its participation in the Partnership, the employer agrees to have in place
an effective safety and health management system containing:
- Meaningful input from employees meeting or exceeding the OSHA Guidelines for
Safety and Health programs published in 1989
- Employee involvement in the safety and health management system
- Employee training for avoidance of hazards specific to the Associate
Contractor's work site(s)
- Providing construction site supervisors with safety training

Partnership Results:
As a result of the collaborative efforts between the Occupational Safety and Health Administration (OSHA) and AGC through this Partnership, more than half of all participating contractors now have a full time safety manager or director.
Training was an elemental part of this Partnership as the participating AGC members worked on improving their safety and health management programs. With this Partnership, employees working directly for the participating members all received safety training with a large majority obtaining an OSHA 10 hour card. In addition to the 10 and 30 hour Construction courses, the training topics included first aid/CPR and accident investigations.
At the conclusion of the Partnership, due to the participating members’ efforts, the three-year rate Total Case Incidence Rate (TCIR) and Days Away, Job Restricted or Transferred (DART) rate were 3.7 and 2.3 respectively, which were 31% and 15% below the industry averages for the construction industry according to the Bureau of Labor Statistics (2006). |

At the conclusion of the 2005 evaluation period which was the last evaluation with reported data from the participating members, the contractors’ aggregate Total Case Incidence Rate (TCIR) and Days Away, Job Restricted or Transferred (DART) rate were both zero, well below the 2004 BLS industry averages of 6.1 and 3.0, respectively.
Due to lack of participation and submission of data for evaluation purposes, this Partnership was not renewed when its second term ended on September 30, 2007. |

Partnership Results:
This Partnership was one of the long lasting Houston area AGC Partnerships, and it has improved safety and health conditions for thousands of subcontractor employees through the collaborative efforts of these general contractors with the assistance of the Occupational Safety and Health Administration (OSHA).
The participating members were extremely involved, as evidenced by their attendance at the training sessions conducted over the life of the Partnership. Highlights of these trainings included Spanish-language training sessions and OSHA 10- and 30-hour courses.
Local Area Directors and Compliance Assistance Specialists from the Houston North and Houston South Offices regularly attended monthly AGC safety committee meetings to discuss local and state fatality trends, new, pending, and proposed regulations and industry trends. OSHA also assisted in teaching the AGC Hispanic Safety Training program on a quarterly basis and covered the ‘All About OSHA’ portion for AGC sponsored 10 and 30 hour construction courses. OSHA also participated in the planning committees for the Houston area AGC Safety Stand Downs held on an annual basis.
At the conclusion of the Partnership, the aggregate Total Case Incidence Rate of the participating members exceeded expectations with a rate 15% below the construction industry average rate as determined by the Bureau of Labor Statistics (2007). |

At the conclusion of this very active Partnership, it increased its total participants from 12 to 18. In the final evaluation period, more than 8,000 training hours were provided under this Partnership, with an emphasis on conducting Occupational Safety and Health Administration (OSHA) 10- and 30-hour trainings.
Local Area Directors and Compliance Assistance Specialists from the Houston North and Houston South Offices regularly attended monthly AGC safety committee meetings to discuss local and state fatality trends, new, pending, and proposed regulations and industry trends. The Partnership was very successful and eliminated hazards from the work place protecting employees and improved their working conditions. With the assistance of AGC and the Occupational Safety and Health Administration, the participating members improved on their safety and health programs. For example, during the final evaluation period, the members conducted more than 2,500 self-inspections and abated more than 2,100 hazards. |

Construction Health and Safety Excellence
The third model, no longer active in Region VI, but still active in other
regions, utilizes a 3-step program designed to assist general contractors with
the implementation of their safety and health management systems. On March 12,
1998 and renewed on January 9, 2001 the Associated General Contractors (AGC) of
America and the Department of Labor, Occupational Safety and Health
Administration (OSHA) signed a National partnership charter that mutually
recognized the importance of providing a safe and healthful work environment in
the construction industry. This partnership approach is called the "Construction
Health and Safety Excellence (CHASE) program.
With the CHASE program, AGC and OSHA hope to encourage more contractors to
implement effective safety and health management systems and to reduce by 3%
annually the number of injuries, illnesses, and deaths resulting from the 4
leading causes of deaths on construction sites (falls, struck-by, electrical and
caught-between).
In CHASE, there are 3 tiers of safety and health performance, Red, White, and
Blue. To achieve White or Blue-level status, contractors must implement
practices that go above and beyond what OSHA requires. In return for meeting the
various criteria, OSHA, after making a verification inspection will not target
the site for a planned inspection within the following 12 months, among other
benefits. This frees scarce OSHA resources from inspecting safe sites and lets
contractors show owners that they are among the best in terms of health and
safety.

Partnership Results:
At the completion of this Partnership, the aggregate Total Case Incidence Rate (TCIR) was 20% below the national average for the Construction industry as reported by the Bureau of Labor Statistics. Also, the Days Away, Job Restricted or Transferred (DART) rate was 40% below the industry average.
During the Partnership, participating contactors received training including 10 and 30 hour OSHA courses and training sessions on scaffolding, excavations, first aid, recordkeeping, crane operating, and transportation safety.
The Occupational and Safety Health Administration (OSHA) also benefitted from having the positive relationships with the partnering companies. For example, OSHA marketed free training opportunities to the partners such as free Spanish OSHA 10 hour classes sponsored by the Hispanic Contractor’s Association. Partners were also able to take advantage of free Focus Four, OSHA 10 hour, and confined space training as a result of the Harwood grants at the national Voluntary Protection Programs Participants’ Association (VPPPA) Conference held in San Antonio in May 2007.
Due to changes to the OSHA Strategic Partnership Program directive, this Partnership was closed out and a new Partnership was formed to allow this collaborative effort to conform to the new directive. |

Partnership Results:
During the final evaluation period, the 3 contractors in this Partnership representing almost 55,000 employees achieved Total Case Incidence Rate (TCIR) and Days Away, Restricted or Transferred (DART) rate of 1.6 and 1.2 respectively, with both well below the Bureau of Labor Statistics National Averages for the Construction industry, by 68% and 63% respectively. This was attributed to AGC’s emphasis on safety and health management which was materialized by over 4,000 hours of training for over 250 employees and 400 supervisors. Training subjects included cranes, scaffolds, confined spaces, trenching, fall protection, driver safety, and First Aid.
Also, self-inspections were strongly emphasized as an integral component of a successful safety and health management systems. The partnering companies reported 506 self-inspections performed identifying over 780 hazards. OSHA contributed to the effort by providing technical assistance and attending safety committee meetings in addition to performing enforcement inspections as verification with all three inspections in compliance.
This Partnership was concluded only two years after its signing in order to cease the duplication of efforts of the local Area Offices participating in the several state-wide AGC Partnerships, and the participating members were encouraged to join the AGC Statewide Partnership. |

Partnership Results:
This Partnership provided awareness of safety and health processes to its partners and their subcontractors by providing training, education, and proactive measures. Training on forklifts, fall protection, and Occupational Safety and Health Administration (OSHA) 30 Hour were provided to the participating members. OSHA contributed to the Partnership by performing 4 consultation visits in the most recent evaluation period in addition to the 2 enforcement verification inspections, which both were in compliance. While the 2009 Total Case Incidence Rate (TCIR) remained slightly above the national average for the construction industry as determined by the Bureau of Labor Statistics (BLS), it represented an almost 75% reduction compared with the previous year’s results. Also, the 3-year Days Away, Job Restricted or Transferred (DART) rate was below the national average for the construction industry as determined by BLS (2009).
This Partnership was concluded approximately two years after its signing in order to cease the duplication of efforts of the local Area Offices participating in the several state-wide AGC Partnerships, and the participating members were encouraged to join the AGC Statewide Partnership. |

Partnership Results:
During the most recent evaluation period, the OSP maintained TCIR and DART rates of 3.8 and 1.8 respectively, continuing to meet and exceed the OSP goals of injury and illness rates of 15% below the industry averages and an Experience Modification rate of .85 or less. Both rates are below the industry averages for Construction as reported by the Bureau of Labor Statistics.
The results can be attributed to AGC’s emphasis on safety and health management which was materialized by the training for its employees and supervisors. For the past five years, this OSP offered an 8 hour Spanish construction safety class each quarter with additional classes offered upon request.
Also, self-inspections were strongly emphasized as an integral component of a successful Safety and Health management System (SHMS). In 2010, the partnering companies reported 1,364 self-inspections performed identifying over 1,100 hazards. OSHA contributed to the effort by providing technical assistance and attending safety committee meetings in addition to performing enforcement inspections as verification with all three inspections in compliance.
In 2011, the OSP planned to continue to work with AGC to identify interested subcontractors. Also, additional training opportunities were explored. However, the involvement in the OSP’s training was already at a high level and AGC also planned to conduct training, including Harwood grant related training, which was available to partnering companies.

Partnership Results:
In 2010, the 6 contractors representing more than 1,300 employees achieved TCIR and DART rates of 1.6 and 0.8 respectively which exceeded the requirement of having injury and illness rates 15% below the industry averages. Both are well below the BLS National Averages for the Construction industry, by 63% and 65% respectively. This can be attributed to AGC’s emphasis on safety and health management which was materialized by training. Also, self-inspections were strongly emphasized as an integral component of a successful SHMS. In 2010, the partnering companies reported over 3,500 self-inspections performed identifying almost 2,400 hazards. OSHA contributed to the effort by providing technical assistance and attending safety committee meetings in addition to performing enforcement inspections as verification with all eight inspections in compliance.
As a part of this OSP’s emphasis on sharing of information, the ADs and CASs from the Houston North and Houston South Offices attend monthly safety committee meetings to discuss local and state fatality trends; new, pending, and proposed regulations; and industry trends. OSHA also assists in teaching the AGC Hispanic Safety Training program on a quarterly basis. OSHA also assists in the planning committee for the Houston area AGC Safety Stand Down and spoke at a partner site for the Stand Down. OSHA staff also attended a mobile crane inspection course provided by a Partner and its insurance company.
In 2011, OSHA planned to assist in teaching the AGC Focus Four class to be implemented during 2011, which was a replacement for the 8-hour Spanish course, with the course being offered in Spanish for the first four hours with the last four hours conducted in English.

Partnership Results:
This OSP impacts 13 employers and over 100,000 employees who work in the construction industry in the city of San Antonio. During the most recent evaluation period, with the assistance of OSHA and the dedication of the employers and its employees, the OSP experienced an 18% reduction in the overall Total Case Incidence Rate on an annual basis, from 2.8 in 2009 to 2.3 in 2010, which is also 34% below the national average for Construction. Also, its Days Away, Restricted or Transferred (DART) rate saw a 38% reduction, from 2.4 in 2009 to 1.5 in 2010, and also is 13% below the national average. To underscore the OSP’s successes, 83% of the enforcement inspections conducted at the participating sites in 2010 were in compliance.
The safety and health excellence can be attributed to a vigorous implementation and maintenance of the Safety and Health Management Systems (SHMS), as indicated by over 7,000 hours of safety training to the employees covered by the OSP. Furthermore, the OSP reported that its participants conducted almost 1,500 self-inspections resulting in more than 2,600 hazards identified and abated. Employers participating in the OSP have learned the importance of an effective SHMS and this is confirmed by the results.
In 2010, employees from the participating sites attended training on rigging for compliance officers, fall protection, safe driving, scaffolding, and crane operations. OSHA staff also attend monthly safety committee meetings to provide updates on OSHA activity and initiatives and to allow partners to ask questions regarding interpretations of OSHA regulations. |

Partnership Results:
In the first two years of the OSP, the 16 participating members achieved a total aggregate TCIR and DART rates of 2.2 and 0.8 respectively, which was 51% and 65% below the 2009 Bureau of Labor Statistics (BLS) averages for the construction industry. The last full year of injury and illness data provided by the partnership shows that the participating contractors (as a group) continued to maintain their injury and illness rates well below the BLS averages.
During the last evaluation period, 1820 self- inspections were performed by the participating employers, during which 795 hazards were observed and corrected. The participating employers make efforts to involve employees in the self-inspections to better inform employees of hazard location(s), increase employee hazard awareness/recognition skills and to learn the correct method of hazard abatement. Performing self-inspections was one of the integral elements of the partnership that contributed to the very low injury and illness rates.
Also, OSHA staff from the Baton Rouge Area Office provided informational updates to the AGC members on fall protection and heat stress hazard recognition and control. |
