AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
CHARLESTON AREA OFFICE
AND
TRI-STATE CONTRACTORS ASSOCIATION
The Occupational Safety and Health Administration (OSHA) and the Tri-State
Contractors Association (TSCA) recognize the value of establishing a collaborative relationship to
foster safer and more healthful American workplaces. OSHA and TSCA hereby form an Alliance to provide
TSCA members and others with information, guidance, and access to training resources that will help
them protect employees’ health and safety, particularly in reducing and preventing exposure to OSHA’s
four focus hazards: falls, electrical, struck-by and caught-in. In developing this Alliance, OSHA and
TSCA recognize that OSHA’s State Plan and Consultation Project partners are an integral part of the
OSHA national effort.
OSHA and TSCA will work together to achieve the following training and education goals:
- Deliver or arrange for the delivery of construction safety training and education programs to
membership, particularly in the four focus areas of falls, electrical, struck-by and caught-in
between hazards.
- Work with OSHA to update and develop construction safety and health curricula.
- Advise TSCA on OSHA standards, updates, case law and proper abatement techniques.
- Encourage TSCA members to attend OSHA 10- or 30-Hour courses for General Industry and
Construction.
- Utilize OSHA resources and expertise to renew and update training and education programs for union
employees and management regarding injury trends and hazards addressed by OSHA.
- Work with OSHA to communicate and provide safety information to employers and employees in the
construction industry.
OSHA and TSCA will work together to achieve the following outreach and
communication goals:
- OSHA will provide speakers for conferences, exhibits and apprenticeship training programs and
other special meetings related to safety and health training issues.
- Share information among OSHA personnel and industry safety and health professionals regarding
TSCA’s best practices or effective approaches. This may include results publicized through TSCA’s
outreach efforts.
- Promote and encourage TSCA’s membership or worksites’ participation in OSHA’s cooperative programs
such as compliance assistance, the Voluntary Protection Program, Consultation, and the Safety and
Health Achievement Recognition Program.
OSHA’s Alliances provide parties an opportunity to participate in a voluntary
cooperative relationship with OSHA for purposes such as training and education, outreach and
communication and promoting a national dialogue on workplace safety and health. These Alliances have
proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance
with a party, OSHA is not endorsing any of that party’s products or services.
An implementation team made up of representatives of both organizations will meet to develop a plan
of action, determine working procedures, and identify the roles and responsibilities of the
participants. In addition, they will meet at least three times per year to track and share
information on activities and results in achieving the goals of the Alliance. Team members will
include representatives of the OSHA Charleston Area Office, West Virginia OSHA Consultation program,
TSCA and the L.E.A.D. (Labor Education and Development) Safety Training Program.
This agreement will remain in effect for two years. The signatories may terminate it for any reason
at any time, provided they give 30 days written notice. This agreement may be modified at any time
with the concurrence of all signatories.
