AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
NEW JERSEY AREA OFFICE’S
THE NEW JERSEY DEPARTMENT OF LABOR
AND WORKFORCE DEVELOPMENT
AND
THE OPERATING ENGINEERS – LOCAL 825

The Occupational Safety and Health Administration New Jersey Area Offices (OSHA), the New Jersey Department of Labor and Workforce Development (NJDOL&WD) and the Operating Engineers Local - 825 (Local - 825) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA, NJDOL&WD and Local - 825 hereby form an Alliance to provide Local - 825 members and others with information, guidance, and access to training resources that will help them protect employees’ health and safety, by addressing issues such as emergency preparedness and preventing exposure to construction industry hazards such as those found in the road, tunnel, bridge and General Heavy Construction Industry

In developing this alliance OSHA, NJDOL&WD and Local – 825 recognize that OSHA’s State Consultation Project partners are an integral part of this Alliance and the OSHA national effort.

OSHA, NJDOL&WD and Local - 825 will work together to achieve the following training and education goals:
  • Work with OSHA to provide expertise to develop training and education programs regarding construction industry hazards addressing issues such as caught-in-between, struck-by prevention and electrical hazard awareness in the construction industry.
OSHA, NJDOL&WD and Local - 825 will work together to achieve the following outreach and communication goals:
  • Develop and disseminate information through print and electronic media, including electronic assistance tools and links from OSHA’s and the Local - 825’s Web sites.
  • Speak, exhibit, or appear at Local - 825 conferences, local meetings, or other events.
  • Cross-train personnel from OSHA, NJDOL&WD and industry safety and health practitioners in construction management best practices or effective approaches as jointly determined by OSHA, NJDOL&WD and the Local - 825.
  • Promote and encourage Local - 825 members’ participation in OSHA’s cooperative programs such as compliance assistance, the Voluntary Protection Programs, Consultation, and the Safety and Health Achievement Recognition Program.
  • Share information on best practices of Local - 825 members/worksites with others in the industry through outreach by Local - 825 and through training programs and materials developed by OSHA, Local - 825, and/or others. Promote their implementation through print or electronic media, promotion at conferences, and/or other means of reaching out to others in industry.
OSHA and the Local - 825 will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:
  • Raise others’ awareness of and demonstrate their own commitment to workplace safety and health whenever the Local - 825 leaders address groups.
OSHA’s Alliances provide the parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least quarterly to track and share information on activities and results in achieving the goals of the Alliance. The Occupational Safety and Health State Plan Association and the association of state Consultation Projects will participate as well.

This agreement will remain in effect for two years from the date of signing. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.
