AGREEMENT ESTABLISHING AN ALLIANCE

The Occupational Safety and Health Administration (OSHA) and the City of New York, Office of the Chief Medical Examiner (NYCOCME)
recognize the value of establishing a collaborative relationship to foster safer & more healthful workplaces in New York
City. OSHA and the NYCOCME hereby form an Alliance for the purpose of using their collective expertise to help foster a
culture of fatality prevention while sharing best practices and technical knowledge.
OSHA & NYCOCME agree to establish an Alliance to promote safe and healthful working conditions for workers employed within
the five boroughs of New York City by conducting the following:
Provide OSHA an opportunity to investigate unreported workplace fatalities in situations where the victim may have entered
a secondary facility, such as a hospital prior to becoming deceased. This would be of great importance in circumstances
involving disadvantaged workers.
Develop and deliver training and education programs for reducing and eliminating workplace hazards such as falls, struck
by, electrical and caught in between that are most commonly identified with workplace fatalities, in New York City.
OSHA & NYCOCME will work together to achieve the following training and communication goals:
OSHA will train the Medicolegal Investigators in the OSHA 10 hour construction course. Based on this knowledge the
Medicolegal Investigators would be better able to identify workplace safety and health hazards. This could lead to the
prevention of workplace fatalities within the five boroughs of New York City.
The NYCOCME will make staff training available to OSHA regarding fatality investigative procedures.
OSHA & NYCOCME will use their resources to promote and advertise workplace safety & health issues, especially those related
to fatality prevention and the OSHA Hispanic Initiative. This would include OSHA providing information about workplace safety
and health issues to the office of the NYCOCME in both English & Spanish.
OSHA will also assist the Medicolegal Investigators in obtaining any reference information on workplace safety & health issues.
OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes
such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health.
These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance
OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose
of promoting a particular party's products or services.
An implementation team made up of representatives of both organizations will meet to develop a plan of action and identify
roles and responsibilities of the participants. In addition, they will meet as needed to discuss the Alliance and improve any
aspects of it.
This agreement will remain in effect for two years from the date of signing. Any signatory may terminate it for any reason at
any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all
signatories.
