AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE U.S. DEPARTMENT OF LABOR
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
MANHATTAN AREA OFFICE
TARRYTOWN AREA OFFICE
AVENEL AREA OFFICE
AND
THE NEW YORK CITY DEPARTMENT OF ENVIRONMENTAL PROTECTION
DIVISION OF EMERGENCY RESPONSE AND TECHNICAL ASSESSMENT

The Occupational Safety and Health Administration (OSHA) and The New York City Department of Environmental Protection, Division of Emergency Response and Technical Assessment (NYC DEP/DERTA) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and NYC DEP/DERTA hereby form an Alliance to provide employers with information, guidance and access to training resources that will help them protect employees’ health and safety, in particular in reducing and preventing exposures to hazardous substances. In developing this Alliance, OSHA and NYC DEP/DERTA recognize that OSHA’s State Plan and Consultation Project partners are an integral part of the OSHA national effort.

OSHA and NYC DEP/DERTA agree to establish an Alliance to promote safe and healthful working conditions for workers employed within the five boroughs of New York City by working together to achieve the following training and education goals:
  • Deliver or arrange for the delivery of NYC DEP/DERTA training courses to OSHA personnel on the New York City Right to Know Law New York City Administrative Code 24-701-718 and Regulations NYCRR 40-01-14 addressing such issues as safe hazardous substance storage and use.

  • Deliver or arrange for the delivery of OSHA Hazard Communication (29 CFR1910.1200) training courses to NYC DEP/DERTA personnel addressing such issues as Material Safety Data Sheets, labeling of hazardous substances, training, and written hazard communication program.
OSHA and NYC DEP/DERTA will work together to achieve the following outreach and communication goals:
  • Coordinate appropriate intervention for those establishments that do not provide safe and healthful workplaces in relation to potentially harmful exposure to hazardous substances during storage and use.

  • Share information among OSHA personnel and NYC DEP/DERTA safety and health professionals regarding OSHA and NYC DEP/DERTA best practices and effective approaches. When appropriate, NYC DEP/DERTA and OSHA will publicize results through outreach or by developed materials, training programs, workshops, seminars and lectures (or any other applicable forum) related to the safe storage and use of hazardous substances.

  • OSHA will provide information about workplace safety and health issues to NYC DEP/DERTA in both English and Spanish.
OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years from the date of signing. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.
