AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
AND
ECUADORIAN – AMERICAN FOUNDATION OF NEW JERSEY, INC. |
The Occupational Safety and Health Administration (OSHA) and The Ecuadorian – American Foundation of New Jersey, Inc.
recognize the value of establishing a collaborative relationship to help reduce the number of Hispanic Worker's killed and
injured in work-related accidents. OSHA's New Jersey Area Offices and the Ecuadorian–American Foundation of New Jersey, Inc.
agree to establish an Alliance to use their collective expertise to help foster a culture of worker health and safety and
accident prevention through a cooperative sharing of best practices and technical knowledge. OSHA and the Ecuadorian–American
Foundation of New Jersey, Inc. will promote safe and healthful working conditions for Ecuadorian–American and other Hispanic
employees by:
- Helping Hispanic employers improve knowledge of safe and healthful work practices and achieve compliance with safety and
health standards and other regulations promulgated pursuant to the Occupational Safety and Health Act of 1970; and
- Increasing access to safety and health training resources and related materials in Spanish for employees who are not fluent
in the English language.
Both organizations acknowledge that when English is not the first language of employers and/or employees in the United
States, access to training and information about safe and healthful work practices may be limited compared to native
English-speakers. To bridge this language barrier and other potential gaps in access, OSHA's New Jersey Area Offices and The
Ecuadorian–American Foundation of New Jersey, Inc. agree to work together to:
- Identify existing OSHA resources such as the OSHA standards in Spanish, the OSHA 10 Hour Construction Industry Outreach
Training Program in Spanish, as well as other safety and health publications, audio-visuals, and reference materials that are
in Spanish, and stimulate the development of new OSHA resources for Hispanic employers and employees as the need for
such resources are identified.
- Seek opportunities to jointly exhibit and disseminate safety and health information at conferences, events, community-based
activities, and through electronic and print media such as: Providing links to OSHA's web site on the Ecuadorian-American
Foundation of New Jersey, Inc.'s Web site; participating in the Ecuadorian-American Heritage Day at Giants Stadium; providing
safety and health seminars in Spanish at the Ecuadorian Consulate; providing articles in Spanish on safety and health topics
for the Ecuadorian-American Foundation's Newsletter; providing the OSHA 10 Hour Construction Industry Outreach Training
Program to employees and employers in Spanish and participating in the Ecuadorian-American Foundation's annual conference.
- Work with the Ecuadorian-American Foundation of New Jersey, Inc. in conjunction with other leadership groups such as the
Ecuadorian Consulate to build safety and health awareness within the Hispanic community;
- Encourage bi-lingual individuals to take the OSHA Train-the-Trainer course on either occupational safety and health
standards for the Construction Industry, occupational safety and health standards for General Industry, or both, so they
qualify to teach Hispanic workers the respective OSHA 10 and 30 hour safety and health Outreach courses in Spanish;
- Promote and encourage participation in the OSHA cooperative programs (e.g. Compliance Assistance, Consultation, and
mentoring) among Ecuadorian– American Foundation of New Jersey Inc. members.
An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine
working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet on a regular
quarterly schedule to track and share information on activities and results in achieving the goals of the Alliance. Team
members will include representatives from each of OSHA's New Jersey Area Offices; New Jersey Department of Labor, OSHA
Consultation Program; and the Ecuadorian-American Foundation of New Jersey, Inc.
This agreement will remain in effect for two years from the date of signing. This agreement may be modified at any time with
the concurrence of the signatories and may be terminated for any reason with 30 days written notice from any signatory.
