AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

The Occupational Safety and Health Administration (OSHA), the New York State Department of Labor’s Consultation Program (NYS Consultation), and Catholic Family Center (CFC) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA, NYS Consultation, and CFC hereby form an Alliance to provide CFC staff, members and others with information, guidance, and access to training resources that will help them protect the health and safety of ESOL and inexperienced workers. In developing this Alliance, OSHA and CFC recognize that OSHA’s State Consultation partners are an integral part of the OSHA national effort.

OSHA, NYS Consultation, and CFC will work together to achieve the following training and education goals:
  • Work with OSHA to provide expertise to develop training and education programs for front line staff so that CFC staff are able to accurately convey pertinent safety and health information to clients during the course of service provision.

  • Increase access to safety and health training resources and related materials in Spanish and other languages for employers and employees.

  • Work with OSHA to provide expertise to develop periodically, safety and health courses in Spanish and in English to workers who are clients of the CFC. If resources are available, conduct safety and health courses in languages other than English and Spanish. OSHA personnel in conjunction with CFC staff will provide this course.
OSHA, NYS Consultation and CFC will work together to achieve the following outreach and communication goals:
  • Make available to employers and workers, safety and health publications, audio-visual and other reference materials that are in Spanish and other non-English languages.

  • Share information among OSHA personnel and industry safety and health professionals regarding CFC best practices or effective approaches and publicize result through outreach by CFC and through OSHA- or CFC- developed materials, training programs, workshops, seminars and lectures (or any other applicable forum).

  • Encourage bi-lingual individuals to take the OSHA Train-the-Trainer course on either occupational safety and health standards for the Construction Industry, occupational safety and health standards for General Industry, or both, so that they can qualify to teach Hispanic and other workers the respective 10- and 30-hour safety and health courses in Spanish and in English.

  • Promote and encourage the employers who hire clients from CFC’s Employment Programs to participate in OSHA’s cooperative programs such as compliance assistance, the Voluntary Protection Programs (VPP), Consultation, and its Safety and Health Achievement Recognition Program (SHARP).
OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s products or services.

The New York State Department of Labor On-Site Consultation Program will provide resources, as necessary and available, to support the training and technical assistance needs of the participants of this alliance. Such assistance may be in the form of on-site consultation visits and/or occupational safety and health training. Findings from any on-site consultation surveys will be kept confidential, so long as the requesting employer agrees to correct any serious hazards that may be identified. There are no costs to the alliance participants for any assistance provided by the On-Site Consultation Program.

An implementation team made up of representatives of the three organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.
