10. Paragraph (g) Vehicles

a. Paragraph (g)(1) and (2) - Maintenance and inspection of vehicles.
OSHA has revised the final rule to cover only those vehicles owned, rented, or leased by the employer. Therefore, vehicle inspection and maintenance requirements do not apply to employee-owned vehicles. However, OSHA notes that the employer has the duty to provide safe access to the worksite.

b. With regard to inspections of equipment (e.g., vehicles, PPE, tools, and machines) covered by the final rule, OSHA never intended that the employer must conduct the actual inspection of the equipment. Employers may assign to others, including employees using the items, performance of the required inspection and maintenance procedures for equipment, but ultimately the employer remains responsible for safe equipment at the workplace.

c. The inspection requirements for equipment in the final rule apply only if the equipment is used during the workshift. If it is not to be used, it does not need to be inspected.
